Terms of Service

X3 Workplace Safety · Effective October 10, 2026 · Operated by X3 Fleet Safety LLC

These Terms of Service (“Terms”) govern the software, websites and services provided by X3 Fleet Safety LLC (“X3,” “we,” “us”) under the X3 Workplace Safety name (the “Services”). By creating an account or using the Services, the customer (“Customer,” “you”) agrees to these Terms.

1. The Services; not legal or professional advice

X3 provides workplace-safety and OSHA-compliance software. The Services, including Ask X3 and any other AI-assisted output, are decision-support tools. They do not constitute legal, medical, engineering, industrial-hygiene or other professional advice. The Services organize information and records; they do not determine whether a workplace is safe or compliant. Customer is solely responsible for its safety and compliance decisions, for having qualified people make them, and for checking outputs before relying on them.

2. What the Services do not do

The Services do not contact emergency services, sound alarms, or notify employees, responders or regulators. The Services do not file reports with OSHA or any other agency. Where a screen helps you prepare a report, a record or a notice, you remain responsible for making it, on time, through the proper channel. In an emergency, call 911.

3. Accounts and eligibility

The Services are for business use by authorized users acting for an employer. Customer is responsible for its users, for keeping its sign-in details confidential, and for keeping its account information accurate.

4. Subscriptions, fees and renewals

Each product is sold as a monthly subscription. The price depends on the number of employees you enter and is shown before you pay. Paid subscriptions renew automatically each month until cancelled. You can cancel at any time from Plan & Billing in your account; cancellation takes effect at the end of the paid month. Fees already paid are not refunded except where the law requires it. We may change prices for future months and will tell you before a change applies to you.

5. Customer data

Customer owns the data it enters. Customer grants X3 a limited license to host and process that data in order to provide the Services. Customer is responsible for having the right to enter the data it enters, including information about its employees, and for meeting its own record-keeping and privacy obligations. Customer should not enter medical records, diagnoses or other information that the Services do not ask for.

6. AI features

Ask X3 and similar features use a third-party AI provider. AI output may be incomplete or inaccurate, is not guaranteed, and must be reviewed by a qualified person before use. Always confirm against the current regulation.

7. Acceptable use

  • No unlawful use, and no entry of personal data without the authority the law requires.
  • No attempt to reverse-engineer, disrupt or get around the Services or their security.
  • No sharing of sign-in details outside your organization, and no resale of the Services.

8. Intellectual property

X3 owns the Services and all related intellectual property, including its checklists, templates and written guidance. Feedback you give us may be used without restriction.

9. Confidentiality

Each party will protect the other’s confidential information and use it only to perform under these Terms.

10. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, X3 disclaims all implied warranties, including merchantability and fitness for a particular purpose. X3 does not warrant that the Services will be uninterrupted or error-free, or that any output will satisfy a regulatory obligation or prevent an injury.

11. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages. X3’s total liability arising out of or relating to the Services will not exceed the fees Customer paid to X3 in the twelve (12) months before the event giving rise to the claim.

12. Indemnification

Customer will defend and indemnify X3 against third-party claims arising from Customer’s unlawful use of the Services, its data, or its breach of Section 5 or 7. X3 will defend and indemnify Customer against third-party claims that the Services infringe intellectual property rights.

13. Term and termination

You may stop using the Services and cancel at any time. We may suspend or end an account for material breach of these Terms or non-payment. For 30 days after termination you may ask us for an export of your data, after which we will delete it unless the law requires us to keep it.

14. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. The state and federal courts located in Michigan have exclusive jurisdiction over any dispute.

15. Changes to these Terms

We may update these Terms and will post the revised version with a new effective date. If a change is material we will ask you to accept the new version when you next sign in.

16. Entire agreement

These Terms, together with the Privacy Policy and any order, are the entire agreement between the parties regarding the Services.
